GENERAL TERMS AND CONDITIONS OF SALES
RUBINACCI website on-line purchases general terms and conditions.
The website http://www.marianorubinacci.it is owned by RUBINACCI SPA with registered office in Naples – Viale Gramsci, 15, Tax Code and VAT No. 00436210637, Business Registry of Naples No. 677216.
These General Terms and Conditions (“TERMS AND CONDITIONS”) are regulated by the Distance Selling Contracts Section of the Consumer Code (Legislative Decree No. 206/2005).
1) General Conditions
The SHOPPING CART website section constitutes an integral and essential part of these General Conditions.
The Customer is encouraged to print or keep these General Conditions.
Any change in these General Conditions shall not affect the General Conditions published on the website at the time the Customer places an order.
2) Offer to the public
The goods and prices published on the website constitute an offer to the public according to the terms stated in the General Conditions and on the website. The conditions of these offers are exclusively applied to purchases made on the website.
Purchase contracts stipulated on the website are concluded with Rubinacci SpA.
All prices not include VAT and are expressed in euro, and delivery costs are shown at the time of ordering.
The price of an item shown on the website when concluding an order will be applied notwithstanding any price changes occurring after or previously offered.
The Customer concludes correctly an order process if the Site does not show any error message.
The contract is intended as concluded when Rubinacci receives an order.
Orders may be tracked at any time by the Customer and it is his/her responsibility to verify the correctness of information supplied and to promptly notify Rubinacci if there are corrections. Any additional costs arising from errors in the information not timely pointed out will be borne by the Customer.
Occasionally the goods offered may not be available; in the event that the goods chosen are not available in whole or in part Rubinacci shall promptly notify the Customer.
5) Methods of payment
Payments can be made on-line using credit card, cheque and PayPal, with the methods specified on the Site.
6) Method and delivery charges
Rubinacci delivers only in the areas specified on the website.
Rubinacci will issue an invoice for the purchased goods, sending it by e-mail to the person who placed the order. The invoice is issued with information supplied by the Customer. It will not be possible to make changes to the information after issuing the invoice.
Delivery charges are paid by the Customer and clearly marked in the order.
Delivery, by specialised shippers, will be within 15 (fifteen) working days after placing the order.
Rubinacci shall not be liable for any delivery delays.
Delivery will be done without an appointment and it is intended to be on the ground floor.
The shipper will make two attempts to deliver the goods at the address provided by the Customer. In case these attempts are not successful, the goods will remain in storage at the shipper’s warehouse for 5 (five) working days available to the Customer.
In case the Customer fails to pick up the goods within the above mentioned terms, the order will be automatically cancelled and the goods returned to Rubinacci. In this case transportation costs will not be reimbursed to the Customer.
Upon delivery, the Customer should check for any damage, humidity or otherwise altered external packaging or closing materials (adhesive tape). Once the delivery document has been signed, the Customer will not be able to make any claims about the external appearance of the delivered goods.
Any problems with the physical integrity, correspondence or completeness of goods received must be reported immediately to Rubinacci for activation of the warranty.
7) Right to Cancel
The Consumer Code rights are due to the customer as a consumer to the extent indicated in such regulations and therefore has the right to cancel the purchase contract in the following manners:
The right to cancel is exercised by sending a registered letter with acknowledgement of receipt within 7 (seven) calendar days from delivery of the goods addressed to:

Communications may be sent within the same terms by telegram, e-mail (firstname.lastname@example.org) or fax (number 081403658) provided that it is confirmed by registered letter with acknowledgement of receipt within 48 hours.
In the event in which the consumer cancels the order in writing, the goods must be returned within 15 (fifteen) calendar days from the date of receipt thereof, sending the goods to the following address:

The consumer must bear the cost of return of the goods.
If the right to cancel was exercised correctly, Rubinacci will reimburse the Customer the whole amount paid within 30 (thirty) days from receipt of the cancellation. The reimbursed amount will be net of costs for delivery of goods.
All goods sold by Rubinacci are supported by legal and commercial warranties.
9) Personal Data Processing
Rubinacci processes the customers’ personal information in compliance with the regulations in matter of personal data protection, as specified in the statement provided in the “Privacy” section.
All communication may be sent to Rubinacci, to the above mentioned address.
Any dispute arising from this agreement will be resolved by the competent court according to applicable regulations.
